This Agreement is made between the applicant for participation in the Kimono Photo Tour (hereinafter referred to as "Client") and Bridal House KOTOBUKI (hereinafter referred to as "KOTOBUKI"), and is effective in all of the following respects from today until the date of the photo shoot.
(1) Contents
The kimono photo tour by Bridal House KOTOBUKI shall provide the Client with skills and products with a high level of knowledge, including authentic costumes, professional photographers, hair and makeup stylists, and interpreters.
(2) Fulfillment of Schedule
KOTOBUKI and the client shall work as a team to shoot the photographs as expressed by the photographer, and shall follow a schedule of dates, times, and locations.
KOTOBUKI will always coordinate the intentions of each professional with the Client.
(3) What is included in the cost
The cost includes the following
Costumes for 2 persons
80 cuts of photo data
Hair and makeup for 1 person and dressing for 2 persons
Attendants
(4) Transportation
Upon client's request, KOTOBUKI's vehicle and driver will provide transportation to and from the event.
Pick-up and drop-off are free of charge.
(5) Force majeure and safety measures
In the event of delay or non-performance of the services under this contract due to the following force majeure, which is not attributable to either the client or KOTOBUKI, neither the client nor KOTOBUKI shall be held in breach of this contract and shall not be held liable for such delay or non-performance.
-1- Disasters such as large-scale earthquakes, floods, infectious diseases, etc.
-2- Riots, wars, civil wars, revolutions, and national divisions
-3- Any legal amendments by government agencies that are deemed to have a material impact on this contract
-4- Suspension of public transportation such as airplanes, railroads, and buses
-5- Other emergencies similar to the above
Change due to weather
The Client understands and agrees that if it is deemed difficult to shoot outside due to rainy weather, the shooting will be switched to indoor shooting.
(6) Difference in color or image of costumes
Clients will be asked to choose costumes from the costumes included in the course.
If after the shooting, the chosen costume is different from the image, the return of the costume will not be accepted.
(7) Possibility of not being able to reproduce the hair style
The client understands and agrees that some styles may not be reproducible due to hair type, color or length. The hair and makeup stylist shall take into consideration the client's wishes and recreate a hairstyle appropriate for the costume.
(8) Permission
KOTOBUKI is responsible for obtaining all necessary permits for all photo shoot locations.
(9) Photographing of others
The Client understands and agrees that since this tour is intended to be photographed at a tourist site, other tourists and passersby may be included in the photographs.
(10) KOTOBUKI's responsibility
KOTOBUKI is not responsible for any dangerous behavior of the client or visitors, or for the client's tardiness, weather conditions, photographic restrictions or regulations that prevent the client from providing an adequate product.
In addition, KOTOBUKI will not be held responsible if costumes cannot be worn if the wrong size is declared by mistake or intentionally.
(11) Client's responsibility
KOTOBUKI will not be responsible for any accidents caused by the client's self-directed behavior or dangerous actions not in accordance with the guide's instructions. In the event of damage to costumes, KOTOBUKI will charge the client for the cost of repairing the costumes.
(12) Delivery of Photographs
Approximately 30 days after the photo shoot, the digital images will be made available for viewing in the online gallery. The photographer retains the right to edit the photos and omit images. The client understands and agrees that not all images taken by the photographer will be provided. The size of the delivered data is 2000 x 3000 pixels at 300 dpi for JPEG images; RAW images will not be made available to the client.
(13) Image Editing
The client agrees to abide by the editorial decisions of the photographer. Photos may be digitally retouched. This includes removing scratches and creating creative effects. The client authorizes the photographer to do so. Retouching requested by the Client will not be accepted.
(14) Backup of Photographs
The Client understands and agrees that the Photographer must retain copies of the tour photographs for 90 days after the tour. After this period, the photographer is not obligated to retain copies or originals of the tour photos; after the 90-day period, it is the client's responsibility to store and back up the data.
(15) Copyright and Advertising Use
Photographer retains the right to use negatives, RAW images, edited images, and or reproductions for advertising, self-promotion, exhibition, publication, or any other purpose, including but not limited to use on the web, Facebook, business cards, or posters. KOTOBUKI will confirm the Client's intention in a separate consent form.
(16) Cancellation Policy
Cancellations will be accepted only if notified by e-mail by 23:59 Japan time 14 days prior to the tour date (for example, if the shooting is scheduled on the 15th of the month, the cancellation must be received by 23:59 Japan time on the 1st of the month). The full amount of the reservation fee of 100,000 yen will be charged even if you cannot join the tour after the 13th day. However, this does not apply in the case of force majeure and safety measures described in ⑤.
(17) Payment
After application, payment site will be informed 3 weeks prior to the tour date. The client shall pay a deposit of 100,000 yen two weeks prior to the tour. The remaining payment must be made at the store on the day of the tour. If the deposit is not paid by the due date, the application will be automatically treated as withdrawn.
